3.1 Agreement

This website and store are operated by Trenddit Limited, trading as Nuvana, a company registered in England and Wales (company number 15967699) with its registered office at 3-5 Westcliffe Drive, Blackpool, FY3 7BJ, United Kingdom ("Nuvana", "we", "us", "our"). "You" means the visitor or customer.

These Terms govern your access to and use of the website and any purchase you make. By browsing the site or placing an order you agree to these Terms, together with our Return and Refund Policy, Shipping Policy and Privacy Policy, each incorporated by reference. If you do not agree, do not use the site.

3.2 Eligibility

You must be at least 18 years old, or the age of majority where you live, to purchase. By ordering you represent that you meet this requirement and that the payment method used is lawfully yours.

3.3 Products, pricing and availability

We aim to describe and display our product accurately. Screens vary, and colour, tone and packaging detail may differ slightly from the images shown.

Prices are in United States dollars and may change without notice. We reserve the right to correct errors in pricing, description or availability, to limit order quantities, and to refuse, cancel or limit any order for any lawful reason, including suspected fraud or reseller activity. Where we cancel a paid order, we refund it in full.

Placing an order is an offer to buy. Our acceptance occurs when we dispatch the order, not when the confirmation email is sent.

3.4 Cosmetic use, no medical claims

Nuvana Scalp Oil is a cosmetic product for external use on the scalp and hair. It is not a drug. Statements on this site have not been evaluated by the Food and Drug Administration. The product is not intended to diagnose, treat, cure or prevent any disease or condition.

Nothing on this site is medical advice and nothing here replaces consultation with a qualified healthcare professional. If you are pregnant or nursing, have a diagnosed scalp or skin condition, or use a prescribed treatment, consult a professional before use.

3.5 Safe use

Patch test before first use. External use only. Avoid contact with the eyes and with broken or irritated skin. Discontinue use if irritation occurs. Do not ingest. Keep out of reach of children. Store away from heat and direct sunlight. Follow the directions on the product label, which govern in the event of any inconsistency with the website.

3.6 Testimonials, reviews and imagery

Reviews and testimonials reflect the individual experience of the person who gave them and are not a guarantee that you will experience the same. Where imagery is illustrative, artist-rendered or AI-generated, it is labelled as such and does not depict customer results or evidence of hair growth.

3.7 Customer content

If you submit a review, photograph, video, comment or other content, you grant Nuvana a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable licence to use, reproduce, modify, adapt, publish, translate and display it in any medium in connection with our business, including advertising, without compensation or attribution.

You represent that the content is yours, is accurate, reflects your genuine experience, and does not infringe any third-party right. We may edit, refuse or remove content at our discretion. We do not offer payment, product or any other incentive in exchange for a positive review.

3.8 Intellectual property

All content on this site — including text, imagery, video, graphics, design, layout, the Nuvana name and logo — is owned by or licensed to Nuvana and is protected by intellectual property law. You may not copy, reproduce, republish, scrape, distribute or use it commercially without our prior written permission.

3.9 Accounts

If you create an account you are responsible for the confidentiality of your credentials and for all activity under it. Notify us immediately of unauthorised use. We may suspend or terminate an account that breaches these Terms.

3.10 Prohibited uses

You may not use the site for any unlawful purpose, to transmit malware, to interfere with its operation or security, to scrape or harvest data, to impersonate any person, to submit false information, or to infringe the rights of others.

3.11 Third parties

We use third-party providers for payment processing, hosting, fulfilment, analytics and marketing, and the site may link to third-party websites. We do not control and are not responsible for their content, practices or policies.

3.12 Disclaimer of warranties

To the fullest extent permitted by law, the site and products are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the site will be uninterrupted, secure or error free.

3.13 Limitation of liability

To the fullest extent permitted by law, Nuvana and its officers, employees, agents and suppliers are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the site or products, whether in contract, tort or otherwise.

Where liability cannot be excluded, our total aggregate liability is limited to the amount you actually paid for the order giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. Where that is the case, the above applies to the maximum extent permitted, and nothing in these Terms excludes liability for fraud, personal injury or death caused by negligence, or any liability that cannot lawfully be excluded.

3.14 Indemnity

You agree to indemnify and hold harmless Nuvana against any claim, loss, liability, cost or expense, including reasonable legal fees, arising from your breach of these Terms, your misuse of the products, or your violation of any law or third-party right.

3.15 Governing law and disputes

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute arising from them.

If you are a consumer, this choice of law and courts does not take away any protection you have under the mandatory consumer protection laws of the country, state or province where you live. You may rely on those protections and bring proceedings in your local courts where those laws allow.

Before commencing proceedings, you agree to contact us at hello@nuvanahealing.com and allow 30 days to resolve the matter informally.

3.16 Severability and waiver

If any provision is found unenforceable, it is severed and the remainder continues in effect. Our failure to enforce any provision is not a waiver of it.

3.17 Changes

We may update these Terms at any time. The version published at the time of your order governs that order. Continued use of the site after changes constitutes acceptance.
